Pennsylvania law applies in auto accident case that occurred in Ohio
Superior Ct. rules that policies and interests in case concern Pennsylvania law and regulations
(8/12/2022) - The Pennsylvania Superior Court in Racicot v. Erie ruled on Aug. 9 that Pennsylvania law should have applied in a UIM proceeding which arose after a PA insured was involved in a motor vehicle accident with a driver from Ohio. The Superior Court applies the Pa. Supreme Court test from Griffiths where the "place of accident test" was abandoned and goes with the state that has the most interest. The opinion includes a discussion on the current status of the law in this area.
